ECHO1. Acceptance of These Terms
These Terms of Use ("Terms") form a binding agreement between you and the developer of Echo (the "App", "we", "us", or "our"). By downloading, accessing, or playing the App, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
3. License to Use the App
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on devices you own or control, solely for your own non-commercial entertainment. This license does not transfer any ownership of the App to you.
If you downloaded the App from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement (EULA), and you acknowledge that Apple has no obligation to provide maintenance or support for the App.
4. Accounts & Sign in with Apple
You can play as a guest, with progress stored on your device. To join the leaderboard and sync across devices, you may create an account using Sign in with Apple and choose a unique username. You are responsible for activity that occurs under your account and for keeping access to your Apple ID secure. You agree that the information you provide is accurate and that you will not impersonate others or select a username that infringes on the rights of others.
5. Your Content
Certain features let you submit content, such as your username and bio ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it within the App (for example, on your public profile and the leaderboard) for the purpose of operating the game.
You agree not to submit User Content that is unlawful, hateful, harassing, sexually explicit, deceptive, infringing, or that contains personal information about others. We may remove User Content or reset usernames that violate these Terms, and we provide an in-app reporting tool so players can flag inappropriate profiles.
6. Acceptable Use
When using the App, you agree not to:
- Cheat, exploit bugs, use unauthorized automation, or otherwise manipulate scores, the leaderboard, or in-game currency;
- Reverse engineer, decompile, modify, or create derivative works of the App, except to the extent this restriction is prohibited by applicable law;
- Interfere with, disrupt, or place undue load on the App or its supporting services;
- Access the App through unauthorized means or circumvent any security or access controls;
- Use the App for any unlawful purpose or in violation of these Terms or any applicable law.
7. Virtual Items & In-Game Currency
The App includes virtual items such as in-game currency ("acorns") and unlockable cube heroes. These items are licensed, not sold, to you for use within the App only. They have no monetary value, cannot be exchanged for real money or goods, and are non-transferable outside the App. We may manage, modify, regulate, or remove virtual items at any time, and we are not liable for the loss of virtual items, including upon account deletion or discontinuation of the App.
8. Purchases
The App offers an optional one-time purchase, "Echo Pro", which removes advertisements. All purchases are processed by Apple through the App Store and are subject to Apple's terms. Prices are shown before you confirm a purchase and may vary by region. You can restore eligible purchases from within the App.
Because purchases unlock digital content immediately, they are generally non-refundable except where required by law or by Apple's policies. Refund requests are handled by Apple through your App Store account, not by us.
9. Advertisements
The App is free to play and supported by advertising for players who have not purchased Echo Pro. Advertisements are provided by third parties and may be subject to those parties' terms. We are not responsible for the content of third-party ads or for any products or services they promote.
10. Intellectual Property
The App and all related content — including its code, characters, artwork, audio, logos, "Echo" branding, and design — are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license granted in Section 3, no rights are granted to you. You may not use our trademarks or assets without our prior written permission.
11. Updates, Changes & Availability
We may update, modify, suspend, or discontinue the App or any feature (including the leaderboard, virtual items, or online services) at any time, with or without notice. We do not guarantee that the App will always be available, uninterrupted, or error-free.
12. Termination
You may stop using the App at any time and delete your account from Settings → Danger Zone → Remove Account. We may suspend or terminate your access to the App or online features if you violate these Terms or engage in conduct that harms other players or the service. Sections that by their nature should survive termination (including Sections 7, 10, 13, 14, and 15) will continue to apply.
13. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or USD 25. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App, your User Content, or your violation of these Terms or of any law or third-party right.
16. Third Parties & Apple
Apple is not a party to these Terms and is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Our service providers (including Apple and Google) are governed by their own terms and privacy policies.
17. Governing Law
These Terms are governed by the laws applicable in the developer's principal place of business, without regard to conflict-of-laws principles, and without limiting any mandatory consumer-protection rights you may have in your country of residence. Where permitted, disputes will be resolved in the courts of that jurisdiction.
18. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
